This Privacy Policy explains how J. Valentine, Inc. ("J. Valentine," "we,"
"us," or "our") collects, uses, shares, and protects information when you
visit jvalentinecatalog.com (the "Site"), apply for or use a wholesale
account, place an order, participate in our drop ship program, sign up for our
emails, or otherwise interact with us.
J. Valentine is a wholesale manufacturer and distributor and is part of the
Roma Costume, Inc. family of companies. This Site and this Policy are directed
to businesses and business buyers — retailers, distributors, and drop shippers
— and to the individuals who act on their behalf. Our affiliated brands at
romacostume.com and romaretailshop.com operate under their own privacy
policies.
We are a United States business and this Policy is written for customers in
the United States. See Section 16.
1. INFORMATION WE COLLECT FROM YOU
We collect information you give us directly, including:
Wholesale account application information. When you apply for an account, we
collect your shop name, shop website, whether you are applying as a wholesale
buyer or a drop shipper, your first and last name, your primary contact phone
number, your email address, your account password, your street address, city,
state or region, postal code, billing country, and how you heard about us.
Reseller verification documents. Before we open an account we require proof
that you are a legitimate reseller. Depending on your business, that may
include your resale certificate, seller's permit, federal employer
identification number or other tax identification number, business license, or
another government-issued certificate. You send these to us outside the Site;
see Section 14 for the channel we ask you to use.
If you are a sole proprietor and your certificate or permit shows a Social
Security number, you may redact all but the last four digits before sending it
to us, or give us a federal employer identification number instead. We do not
need your full Social Security number to verify your reseller status, and we
ask you not to send it.
Buyer contact information. We collect the name, title, email address, and
phone number of the individuals authorized to place orders or manage the
account on your company's behalf.
Order information. We collect the products you buy, quantities, sizes, order
and reorder history, purchase orders, quick order form entries, shipping and
billing addresses, special instructions you add to your cart, and whether you
would like your order combined with an order from one of our affiliated
brands.
Account credentials. We collect your username and password. An account is
required to place an order. See Section 7 for how we treat credentials.
Payment information. The card or bank details you enter at checkout are
transmitted directly to our payment providers. We receive only limited
information such as the last four digits of the account, the card brand, and
the billing ZIP code. See Section 8.
Drop ship information. If you participate in our drop ship program, you
provide us with the name, shipping address, and order details of your own
customers so we can ship on your behalf. If one of your customers ships a
return directly to us, we receive their name, return address, and anything
they include with the package. See Section 6 for how we handle that
information.
Communications. We collect messages, emails, chat transcripts, returns and
claims correspondence, and customer service tickets you send us, including any
images you attach.
Marketing and alert preferences. We collect your subscription status for our
email list, any back-in-stock notification requests you submit, and the
product categories you tell us you are interested in.
We collect this information because we need it to evaluate and open your
account, verify your resale status, fulfill your orders, respond to your
requests, and meet our legal obligations. If you choose not to provide certain
information, we may not be able to open a wholesale account or process your
order.
2. INFORMATION WE COLLECT AUTOMATICALLY
When you visit the Site, we and our service providers automatically collect
certain information about your device and your activity, including:
- Device and connection data: IP address, device type, operating system,
browser type and version, screen resolution, language settings, and unique
device or advertising identifiers.
- Usage data: the pages and products you view, the links you click, search and
filter terms you enter, items you add to your cart, referring website, time
zone, and the dates and times of your visits.
- Approximate location: a general geographic location (such as city, state, or
country) inferred from your IP address. We do not collect precise GPS
location from the Site.
- Cookies and similar technologies: cookies, pixels, web beacons, tags, local
storage, and software development kits placed by us and by our partners. See
Section 9 for details.
We collect this information whether or not you have a wholesale account.
3. INFORMATION WE RECEIVE FROM THIRD PARTIES
We may receive information about you or your business from:
- Our e-commerce platform and hosting provider, which processes orders,
accounts, and site activity on our behalf.
- Payment processors and fraud-prevention providers, which return
authorization results, fraud risk scores, and chargeback information.
- State tax authorities and verification services, when we validate a resale
certificate or seller's permit.
- Shipping and freight carriers, which provide delivery status and address
validation.
- Advertising, social media, and analytics platforms, which provide campaign
performance data and audience information.
- Our affiliated brands and commonly operated companies, where you hold an
account with more than one of them or ask us to combine an order.
- Artificial intelligence shopping agents and other automated buying tools, if
you use one to browse or order from the Site. See Section 6.
- Trade shows, showroom and sales representative networks, industry
directories, publicly available sources, and business partners, where
permitted by law.
4. HOW WE USE YOUR INFORMATION
Except for drop ship customer information, which we use only as described in
Section 6, we use the information we collect to:
- Evaluate wholesale account applications and verify that an applicant is a
legitimate reseller, including validating resale certificates, seller's
permits, tax identification numbers, and business licenses.
- Create and manage your account, authenticate users, control who may place
orders on the account.
- Process, fulfill, ship, and track orders, including drop ship orders sent to
your customers, and handle returns, exchanges, credits, and defect or
shortage claims.
- Combine your order with an order you place with one of our affiliated
brands, when you ask us to.
- Communicate with you about orders, shipments, back-orders, back-in-stock
alerts, line sheets, new releases, and customer service inquiries.
- Send you marketing emails about new collections, seasonal lines, closeouts,
and trade shows, and measure how you engage with them.
- Operate, maintain, secure, test, and improve the Site and our products.
- Detect, investigate, and prevent fraud, unauthorized reselling, chargebacks,
unauthorized account access, and other illegal or prohibited activity.
- Perform analytics, forecast demand, plan production, and measure advertising
performance.
- Comply with our legal obligations, including tax, sales and use tax,
accounting, product safety, and record-keeping requirements, and establish,
exercise, or defend legal claims.
We do not train our own artificial intelligence models on your information,
and we do not sell it to data brokers or to artificial intelligence developers
for model training. Some vendors we use may improve their own services,
including machine learning features, using data they process on our behalf, as
permitted by their terms.
5. EMAIL AND DIRECT MARKETING
If you subscribe to our newsletter, apply for an account, or place an order,
we may send you promotional emails about new collections, seasonal lines,
closeouts, and trade show appearances. If you request a back-in-stock alert,
we use your email address to send that alert.
You can opt out at any time by clicking the "unsubscribe" link at the bottom
of any marketing email, or by emailing us at Sales@JValentineCatalog.com. We
will honor your request promptly, and in any event within ten business days.
Opting out of marketing does not stop transactional messages about an account
or order, such as order confirmations, shipping notices, invoices, and returns
correspondence.
We use more than one email platform. Unsubscribing suppresses your address in
the platform that sent the message, and on request we will suppress it across
all of our platforms and brands. If you receive a message after
unsubscribing, tell us and we will suppress you everywhere.
We do not send marketing text messages. If that changes, we will update this
Policy and obtain your express written consent before sending any.
6. HOW WE MAY SHARE INFORMATION
We do not sell your personal information in exchange for money. However,
because of how we use advertising and analytics cookies and pixels, and how
independent sales representatives use buyer contact information, our sharing
of online identifiers, activity data, purchase information, buyer contact
details, and the preferences we infer from them is treated as a "sale" or
"sharing" of personal information under California law, and as "targeted
advertising" under other state privacy laws. You can opt out at any time —
see Sections 10 and 13.
We share information in the following ways:
- Service providers. We share information with companies that perform services
for us, including our e-commerce platform and hosting provider, payment
processors, fraud-prevention services, shipping and freight carriers,
warehouse and fulfillment vendors, customer support and ticketing platforms,
email marketing and back-in-stock notification platforms, and analytics
providers. We require these companies by contract to use the information
only to provide services to us and not for their own purposes.
- Bot-detection and CAPTCHA providers. Our forms are protected by a
third-party CAPTCHA service that receives device and interaction signals
from your browser. That provider uses those signals for its own security and
machine-learning purposes under its own privacy policy, not ours.
- Resale verification. We share reseller documents, and the tax identification
information in them, with state tax authorities and the verification
services that confirm a resale certificate or seller's permit.
- Acquiring banks, card networks, and issuing banks, when we respond to a
payment dispute or chargeback.
- Affiliated brands and commonly operated companies. J. Valentine is part of
the Roma Costume, Inc. family of companies. We share information with Roma
Costume, Inc. and other commonly operated brands where you hold an account
with more than one of them, where you ask us to combine an order across
brands, and where an order is fulfilled from our shared Burbank facility.
- Independent sales representatives and showroom agencies who represent our
lines. They receive buyer contact information and account status so they can
service your account. Where a representative also uses that information for
their own purposes, that sharing is treated as a "sale" under California law
and you may opt out as described in Sections 10 and 13.
- Advertising, analytics, and email platforms. We share online identifiers,
device information, and browsing and purchase activity with advertising
networks, social media platforms, and analytics providers so we can measure
performance and show relevant ads. Our email and analytics platforms also
receive your name, email address, phone number, and address.
- Legal and safety. We may disclose information if we believe disclosure is
required by law, subpoena, court order, or other legal process; to cooperate
with law enforcement, tax authorities, or regulators, including the Consumer
Product Safety Commission and state product safety authorities where we are
required to report a product safety issue; to enforce our Terms of Service
or our agreements with you; or to protect the rights, property, or safety of
J. Valentine, our customers, or the public. We also share information with
our attorneys, accountants, auditors, and insurers.
- Business transfers. If we are involved in a merger, acquisition, financing,
reorganization, bankruptcy, or sale of all or part of our assets,
information may be transferred as part of that transaction.
- With your direction or consent. We share information in other ways when you
ask us to or agree to it.
Drop ship customer data. When you send us the names and addresses of your
customers so that we can ship on your behalf, we act as your service provider
under a written contract that limits what we may do with that information. We
use it only to pick, pack, ship, and track the order, to handle returns and
claims, and to comply with law. We do not use it for our own marketing, we do
not add those individuals to our email list, and we do not sell or share it.
We share it with the carriers and consolidators that deliver the shipment.
Where a shipment leaves the United States, we also provide the recipient's
name and address, and where the destination country requires it a recipient
identification number, to customs authorities, customs brokers, and the
carrier's customs agents. If we defend a payment dispute involving the order,
we provide the order details to the acquiring bank, card network, and issuing
bank.
If you forward us a request from one of your customers to delete or correct
their information or to opt out, we will act on it and pass it to the vendors
that hold that information for us. We will tell you if we determine we can no
longer meet our obligations to you. You remain responsible for having a lawful
basis to give us that information and for the privacy notice you provide to
your own customers. If one of your customers contacts us directly about their
information, we will tell them we cannot act on the request and will refer
them to you. A return sent to us directly by one of your customers is handled
under the same limits.
Automated shopping agents. Our Site supports agent-assisted purchasing. An
agent can search our catalog, build a cart, and prepare a checkout, but
payment requires your explicit approval at the time of purchase. The agent
transmits your identity and shipping address to us on your behalf, and card
details are handled by the payment provider as described in Section 8. Some
agents complete payment through a third-party wallet, in which case that
wallet provider handles your identity, address, and payment method under its
own privacy policy.
We also send order, cart, pricing, shipping, and order-status information back
to the agent so it can act for you. We do not control the agent, and the agent
is not our service provider. We are responsible for the information the agent
sends us and we handle it under this Policy; we are not responsible for what
the agent collects from you or how its provider uses it. When an agent
transacts with us for you, we provide our notice at collection to the agent
and include a link to this Policy in your order confirmation. If you have
opted out of the sale or sharing of your information, that opt-out applies to
orders an agent places for you.
7. SENSITIVE PERSONAL INFORMATION
Under California law, "sensitive personal information" includes account
log-in credentials, a payment card or financial account number in combination
with a security or access code, and a Social Security, driver's license,
state identification card, or passport number. An employer identification
number issued to a company is not personal information, and we treat it as a
business record. Where a sole proprietor uses a Social Security number as
their taxpayer identification number, we treat that number as sensitive
personal information. Card and account numbers and security codes entered at
checkout are transmitted directly to our payment providers; we do not retain
them. We collect account credentials only to create and secure your account.
Where an applicant is a corporation or a limited liability company, the
reseller documents described in Section 1 are business records about the
company. Where an applicant is a sole proprietor, or a single-member business
identified by the owner's own name, the document is personal information about
that individual and we handle it under this Policy accordingly.
We use a government identification number appearing on a reseller document
only to verify your reseller status. We limit access to the staff who need it.
We disclose it to the state tax authorities and verification services that
confirm a resale certificate or permit, to our accountants and auditors in
connection with a sales and use tax audit, to our attorneys where necessary to
establish or defend a legal claim, and to the provider that hosts the system
where the document is stored — and otherwise only where required by law or in
connection with a business transfer. We dispose of it securely as described in
Section 12.
We do not use any of this information to infer characteristics about any
individual, and we use and disclose it only for the purposes described in this
Section. Securing your account, processing your payment, and verifying your
reseller status are all purposes California permits, so we are not required to
offer, and do not offer, a separate option to limit the use of sensitive
personal information.
We do not seek to collect information revealing racial or ethnic origin,
religious or philosophical beliefs, union membership, health or medical
information, genetic or biometric data, citizenship or immigration status, or
data concerning sex life or sexual orientation. Please do not submit this
information to us. We do not infer any of these characteristics from the
products you browse or purchase, and we do not use product categories to build
advertising audiences based on them.
We do not ask for health information. If a claim you send us describes an
injury or reaction, or includes a photograph of a person, we use it only to
investigate the claim, to meet our product safety obligations, and to
establish or defend legal claims. We do not use it for advertising and we do
not use it to infer anything about you or your customer.
8. PAYMENT INFORMATION
Payments on the Site are processed by third-party payment providers,
including accelerated checkout and digital wallet services. When you enter
payment card or bank account details at checkout, that information is
transmitted directly to the payment provider. We do not store full payment
card numbers or card security codes on our systems. We receive limited
information such as the last four digits, the card brand, the billing ZIP
code, and whether the transaction was approved. Your use of a payment provider
is also governed by that provider's own privacy policy and terms.
9. COOKIES AND TRACKING TECHNOLOGIES
Cookies are small text files placed on your device that let a site recognize
your browser and remember information about your visit. We use:
- Strictly necessary cookies, which are required for the Site to work,
including cookies that keep you logged in, maintain your cart, and protect
against fraud. These cannot be turned off through our Site.
- Performance and analytics cookies, which tell us how visitors use the Site
so we can improve it.
- Functional cookies, which remember your preferences and previously viewed
items.
- Advertising and marketing cookies and pixels, which are used by us and our
partners to measure campaigns and show ads and messages on other sites and
apps.
Some of these technologies are operated by third parties who receive
information about your interaction with the Site directly.
You can manage cookies through your browser settings, including deleting
existing cookies and blocking new ones, and through the opt-out options in
Section 10. Blocking cookies may cause parts of the Site to stop working
correctly, including sign-in. Independent information
about cookies is available at allaboutcookies.org.
10. INTEREST-BASED ADVERTISING AND YOUR CHOICES
We work with advertising and marketing platforms to show messages and ads for
our products on other websites, apps, and social media. These partners may use
cookies, pixels, and identifiers to build a profile of your interests.
Global Privacy Control. We are implementing support for the Global Privacy
Control (GPC) signal, which lets your browser tell every site you visit that
you want to opt out of the sale and sharing of personal information. Until
that support is complete, please use the "Your Privacy Choices" link or email
us, and we will apply your opt-out. We do not require you to verify your
identity or create an account to opt out.
Do Not Track. Some browsers send a "Do Not Track" signal. There is no common
industry standard for how to respond to it, and we do not currently respond to
Do Not Track signals. See above for how to opt out.
You can also limit interest-based advertising by:
- Using the "Your Privacy Choices" link in the footer of any page on the Site
to submit an opt-out request.
- Emailing Sales@JValentineCatalog.com with the subject line "Do Not Sell or
Share My Personal Information."
- Adjusting the ad settings offered by the advertising and social media
platforms you use.
- Using the industry opt-out tools at optout.aboutads.info (Digital
Advertising Alliance), optout.networkadvertising.org (Network Advertising
Initiative), and youradchoices.com/appchoices for mobile apps.
- Enabling "Limit Ad Tracking" or an equivalent setting on your mobile device.
Opting out means you will see less relevant ads, not fewer ads. If you are
signed in to your account when you opt out, or you give us your email address
with your request, we apply your opt-out to the profile we maintain for you as
well as to that browser or device. If you are not signed in, your opt-out
applies to that browser or device, and you may need to renew it if you clear
your cookies or use a different browser.
11. CHILDREN'S PRIVACY
The Site is a business-to-business site intended for adults acting on behalf
of a business. We do not knowingly collect personal information from anyone
under 13, and we do not knowingly sell or share, or process for targeted
advertising, the personal information of any consumer under 18. If we learn
that we have collected information from a child under 13, or that we have
sold, shared, or used for targeted advertising the information of a consumer
under 18, we will delete it or stop that processing promptly. If you believe a
child has provided us with personal information, contact us at
Sales@JValentineCatalog.com.
12. DATA RETENTION
We keep information only as long as we need it for the purposes described in
this Policy. Our retention periods are:
- Order, invoice, and transaction records: 7 years from the date of the
transaction, to meet tax, sales and use tax, and accounting requirements.
- Resale certificates, seller's permits, tax identification records, and
exemption documents: for as long as the account is open and 7 years after it
closes, because tax authorities may audit exempt sales for that period.
- Wholesale account and buyer contact information: for as long as the account
is active, then 24 months after closure so we can resolve disputes and
prevent fraud.
- Payment tokens held by our payment providers: until you remove the payment
method or close your account.
- Drop ship customer information: 18 months from shipment, so we can handle
returns, claims, and carrier disputes, unless you ask us to delete it
sooner.
- Approximate geolocation and the inferences we draw: up to 24 months.
- Customer service records and communications: 3 years from the last contact.
- Marketing contact information and back-in-stock requests: until you
unsubscribe or the alert is sent. We keep a suppression record in each
platform indefinitely so that we do not contact you again from that platform
by mistake.
- Cookie, analytics, and advertising data: we configure our analytics and
advertising platforms to retain data for no more than 24 months where the
platform allows us to set a retention period.
Where a record falls into more than one category above, the longer period
applies. Where a product is subject to a recall or a report to the Consumer
Product Safety Commission, we keep the minimum contact and order information
needed to notify the recipients of that product for as long as that
obligation applies — notwithstanding the periods above and any deletion
request — and, for drop ship orders, as permitted by our agreement with you.
When we no longer need information, we delete it or aggregate it so it no
longer identifies anyone. We store reseller documents in a single designated
system, delete the message in which a document was sent once it is filed, and
dispose of documents containing government identification numbers by
shredding, burning, or secure erasure. We may also retain information longer
where necessary to resolve a dispute, prevent fraud, or comply with a legal
obligation.
13. YOUR PRIVACY RIGHTS
Business contacts are covered in California. California's exemption for
business-to-business contact information has expired. If you are a California
resident whose information we hold because you work for one of our wholesale
customers, suppliers, or partners, you have the same rights described below as
any other consumer, and we handle your request the same way. Other state
privacy laws generally do not cover individuals acting in a commercial
capacity.
This Policy does not cover personal information we collect from job applicants
or employees, which is described in a separate notice.
Depending on where you live, you may have some or all of the following rights:
- Right to know or access the personal information we have collected about
you, including the categories, sources, purposes, and recipients. California
law does not permit us to include certain values in a response to a request
to know. We will tell you that we hold your Social Security or other
government identification number, financial account number, or account
password, and describe it, but we will not send you the number or password
itself.
- Right to correct inaccurate personal information.
- Right to delete personal information we have collected from you, subject to
legal exceptions. Those exceptions include completing a transaction,
detecting and preventing fraud and security incidents, resolving disputes,
keeping a suppression record so we can continue to honor your opt-out, and
complying with tax, accounting, and other legal obligations. Section 12
describes how long we keep each type of record.
- Right to obtain a portable copy of your information.
- Right to opt out of the sale or sharing of personal information and of
targeted advertising and certain profiling.
- Right to withdraw consent you have given us, such as consent to receive
marketing email (see Section 5).
- Right not to receive discriminatory treatment for exercising your rights.
CALIFORNIA DISCLOSURES
In the twelve months before the date of this Policy:
Categories of personal information we collected: identifiers (name, title,
email address, phone number, business and billing address, IP address, account
and device identifiers, and — for drop ship orders placed by our wholesale
customers — the name and shipping address of the individual recipient);
customer records; commercial information (products purchased, considered, or
returned, and order history); professional or employment-related information
(title, employer, and purchasing authority); internet or other electronic
network activity (browsing, search, and filter history and interactions with
the Site and our messages); audio, electronic, and visual information (chat
transcripts, support tickets, and images submitted with claims); approximate
geolocation; sensitive personal information (account credentials, and any
government identification number appearing on a reseller document, as
described in Section 7); and inferences drawn from the non-sensitive
categories above, such as product and category preferences.
Categories we disclosed for a business purpose, and the recipients: all of
the categories above — except sensitive personal information, which is mapped
by type: account credentials go only to our e-commerce platform and hosting
provider; payment card and account information goes only to our payment
processors and fraud-prevention providers; and a government identification
number appearing on a reseller document goes only to the recipients named in
Section 7 — disclosed to our e-commerce platform and hosting provider,
payment processors, fraud-prevention providers, shipping and freight
carriers, warehouse and fulfillment vendors, affiliated and commonly operated
companies, independent sales representatives and showroom agencies, customer
support and ticketing platforms, email marketing and back-in-stock
notification platforms, analytics providers, and our professional advisors.
Drop ship customer information goes only to our e-commerce platform and
hosting provider, our warehouse and fulfillment vendors, and the carriers and
consolidators that deliver the shipment, other than disclosures required by
law or made in connection with a business transfer.
Categories we sold or shared, and the third parties: online and device
identifiers (including IP address, cookie identifiers, and advertising IDs)
and, for audience matching, hashed business email addresses; internet or
other electronic network activity; commercial information; and inferences
about product preferences — shared with advertising networks, social media
platforms, and analytics providers for cross-context behavioral advertising.
We also disclose buyer contact information and account status to independent
sales representatives and showroom agencies, which is treated as a sale where
the representative uses it for their own purposes. We do not sell or share
sensitive personal information, we do not sell or share drop ship customer
information, and we do not sell or share the personal information of
consumers we know to be under 18.
Categories of sources: you and the individuals who act for your business; our
e-commerce platform and hosting provider; payment and fraud-prevention
providers; state tax authorities and verification services; shipping carriers;
advertising, analytics, and email platforms; our affiliated brands; automated
shopping agents; trade shows, showroom and representative networks, industry
directories, and publicly available sources. Sections 1 through 3 describe
each in detail.
Business and commercial purposes: we use each category for the purposes listed
in Section 4 — opening and verifying accounts, fulfilling and shipping orders,
communicating with you, marketing, site operation and security, fraud
prevention, analytics and advertising measurement, and legal compliance.
Verification: we match the identifiers in your request against the account and
order records we hold. For a request that covers sensitive information or a
large volume of records, we may ask for additional information, such as an
order number or details only the account holder would know.
Lookback: the categories above describe the twelve months before the date of
this Policy. If you ask us for information we collected before that period, we
will provide it going back to January 1, 2022, unless doing so is impossible
or would involve disproportionate effort.
Shine the Light. California residents may once a year request a list of the
personal information we disclosed to third parties for their own direct
marketing purposes, and the identity of those third parties. Email
Sales@JValentineCatalog.com with the subject line "Shine the Light" and we
will respond within 30 days.
U.S. STATE PRIVACY LAWS
Residents of states with comprehensive consumer privacy laws — including
California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky,
Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon,
Rhode Island, Tennessee, Texas, Utah, and Virginia — may exercise the rights
available under their state's law. Additional states have passed laws that
take effect after the date of this Policy. If you live in a state with a
comprehensive privacy law, contact us and we will tell you which rights apply
to you.
If you are an Oregon or Minnesota resident, you may request a list of the
specific third parties to which we have disclosed your personal data. If you
are a Connecticut resident, you may request a list of the third parties to
which we have sold your personal data. If you are a Colorado, Connecticut, or
Minnesota resident, you may have rights regarding profiling that produces
legal or similarly significant effects; we do not currently engage in that
kind of profiling.
Nevada residents may submit a verified request that we not sell covered
information by emailing Sales@JValentineCatalog.com with the subject line
"Nevada Opt-Out." Nevada law requires that this particular request be
verified. We do not currently sell covered information as Nevada law defines
it.
HOW TO EXERCISE YOUR RIGHTS
Email Sales@JValentineCatalog.com with the subject line "Privacy Request,"
call us at 1-866-699-ROMA, or write to us at the address in Section 18. Tell
